Where Is Delta-8 THC Available or Banned?

Delta-8 is a variant of delta-9-tetrahydrocannabinol, one of 113 cannabinoids found in cannabis varieties (hemp or marijuana) (THC). It is psychoactive and intoxicating when consumed, resulting in a “high.” 

However, the effects are much more subdued when compared to delta-9 THC, making it better for beginners who want to experience the euphoric effects without the negative side effects often associated with delta-9. Distillates, vape cartridges, oils, and flowers are just a few of the current product forms for delta-8 THC.

Alabama

With the passage of SB 225, the use, possession, sale, distribution, purchase, and production of delta-8 products is now legal in the state.

Delta-8 is regulated in Michigan in the same way that recreational cannabis is. Unless you are a licensed marijuana retailer, it is illegal to sell delta-8. 

Arizona 

The state’s cannabis regulatory framework places restrictions and regulations on Delta-8 products. According to a newsletter released by the Nevada Cannabis Compliance Board, Delta-8 and other intoxicating THC isomers are Scheduled I controlled substances. Before their goods can be produced and sold, delta-8 businesses must apply for CCB licensing, showing that the state’s current cannabis laws apply to delta-8.  

Minnesota 

In Minnesota, Delta-8 THC is almost certainly prohibited. In June 2022, the state passed legislation limiting goods derived from hemp. They must have a maximum THC content of 0.3%. Additionally, the bill states that each serving of hemp-based edibles cannot contain more than 5 mg of THC. 

Nebraska 

 

Delta-8 is legal in Nebraska because hemp-derived products are exempt from the state’s list of controlled substances. 

Washington 

Delta-8 THC is illegal in the state of Washington. The Liquor and Cannabis Board ruled in September 2021 that marijuana license holders cannot manufacture or sell delta-8 THC products. 

New York 

Delta-8 THC is illegal in the state of New York. The state revised its regulations in May 2021 to make hemp cannabinoid products created through isomerization illegal. This includes THC in the delta-8 and delta-10 ranges. 

Oklahoma 

In Oklahoma, Delta-8 THC is legal. Delta-8 and delta-10 THC are expressly excluded from the legal definition of marijuana by state law. 

Florida 

Under Florida law, hemp-derived delta-8 is legal, meaning its use, possession, sale, distribution, and production are all legal within the state’s borders. There are also no possession restrictions.  

Vermont 

Delta-8 THC is prohibited in Vermont. The state confirmed in April 2021 that producers could not produce delta-8 THC, even from hemp. 

Idaho 

Idaho is well-known for having the most stringent hemp laws in the country. According to House Bill 126 and the Idaho Uniform Controlled Substances Act, no hemp-derived product may contain any percentage of THC or its isomers. As a result, hemp-derived delta-8 is illegal in Idaho under state law, which means that the use, possession, sale, distribution, and production of delta-8 products are prohibited throughout the state.  

Massachusetts 

As a result of the passage of Bill H.4001 and the Agriculture Improvement Act, hemp-derived delta-8 is no longer explicitly prohibited in Massachusetts. However, according to the Massachusetts government website, delta-8 is a controlled substance, and the state will not permit the sale or manufacture of synthetically manufactured hemp-derived delta-8. 

North Dakota 

Delta-8 is now illegal in North Dakota and is classified as a controlled substance under state law, thanks to North Dakota House Bill 1045.However This bill amended the state’s existing hemp bill to include delta-8 as a prohibited substance alongside delta-9 THC.  

Bottomline  

The use of Delta 8 THC products for therapeutic and recreational purposes is legal in some states. Others, on the other hand, don’t bother with legislation because the majority of products are made from hemp and are covered by the 2018 Farm Bill. 

While some states only permit the use of hemp plants in the cultivation of cannabis, Delta 8 THC is frequently a subject of debate. Delta 8 THC is not regarded as a controlled substance in all states.
